Caesars Entertainment’s shareholders are apparently not on board with a recent proposal to study the effects of smoke-free casinos. While activists continue to fervently promote the idea of smoke-free casinos, citing health-related concerns, gambling companies and their investors remain obstinate in maintaining the status quo.

The proposal was filed by public health and labor advocates from the Americans for Nonsmokers’ Rights Foundation and healthcare provider Trinity Health. The aforementioned organizations suggested that implementing a non-smoking policy across Caesars’ 52 properties in the United States could help the company save up money.

However, approximately 80% of Caesars’ shareholders voted against the proposal, following Caesars’ claim that change isn’t needed. For context, the casino operator described its smoking policy as a “complex business decision” and added that it currently complies with local regulations.

Caesars further explained that it doesn’t believe compiling a report on the effects of smoke-free casinos wouldn’t be an “effective use of company resources.”

Smoke-Free Activists Are Encouraged to Continue the Fight

While the proposal was rejected, its proponents said that they were encouraged by the support it received and plan to bring it back in 2025. For context, almost 19% of Caesars’ shareholders voted in favor of the support, sparking hope about the future of smoke-free casinos.

Paula Larson-Schusster, president of United Auto Workers Local 3555 and dealer at Caesars’ Flamingo casino hotel in Vegas, said that the support represents a “forward move.” She added that companies will not be convinced to go smoke-free easily but added that the proposal was but the first step in raising awareness on the matter.

Larson-Schusster was firm that a smoke-free policy would not hurt casino companies’ product but would actually make it more valuable.

Indoor smoking continues to be one of the hot topics of the American casino industry. Many states exempt casinos from the indoor smoking ban, allowing them to dedicate a portion of their gaming area as a smoking zone.

However, proponents of banning smoking at casinos argue that this exposes casino workers to high levels of unhealthy smoke and can potentially lead to health complications.

While casino companies fear that going smoke-free could deal a blow to their profits, supporters of this change point out that there are already casinos that prohibit smoking without seeing a decline in profits.

The multi-front war on smoking also continues in states such as Pennsylvania where CEASE and UAW recently asked lawmakers to end the loophole that allows casinos to offer indoor smoking.

New York state lawmakers Sen. Joseph Addabbo and Assemblyman Gary Pretlow have submitted a bill, which aims to expedite the process of awarding casino licenses in the New York City area. 

New Bill Proposes Earlier Deadline for NYC Casino Licenses to Boost State Revenue

The proposal stipulates that all casino license bids must be submitted by July 31, 2024. The bill also requires the New York State Gaming Commission to approve three licenses by March 31, 2025. As a comparison, according to the current schedule, licenses have to be awarded by December 31, 2025. 

Addabbo and Pretlow submitted the new bill as they consider the current timetable inefficient, reported The New York Post. They further added that it is delaying economic benefits for the state and believe that speeding up the licensing can generate billions of dollars in additional revenue for the state.

Addabbo noted that the prolonged timeline is holding up about 5,000 jobs and that a streamlined process needs to be implemented. The bill’s goal is not to benefit particular bidders but to eradicate the inefficiencies in the current system.

Some industry sources think that the current system is advantageous for those of the bidders who are facing political and zoning challenges. 

For example, Mets owner Steve Cohen, who proposed a $8 billion casino near Citi Field in Queens, and the Related Companies, proposing a $12 billion casino and office tower complex in Manhattan’s Hudson Yards, are some of the projects that are dealing with such hurdles.

However, the accelerated timeline that Addabbo and Pretlow are proposing could benefit existing slot parlors like Resorts World at Aqueduct and MGM Empire City at Yonkers. To get a license, all these entities need to do is expand their facilities to include live card games.

New Legislation Proposes $500M Upfront Fee for NYC Casino Licenses

As per the new legislation proposal, every bidder that gets a license must pay an upfront license fee of at least $500 million. The bill also allows two years to resolve any legal or land-use issues.

However, there are some significant challenges. For example, Cohen’s project needs state legislative approval to redesignate parkland around Citi Field for commercial use. However, state Sen. Jessica Ramos, who represents the area, has not yet backed this approval.

Assemblyman Pretlow, whose district includes the Yonkers racino, has expressed his frustration over the slow pace of the process. He noted that New York state is potentially forfeiting $2 billion in revenue.

Gov. Kathy Hochul, who oversees the gaming commission, has stated that she will review all legislation, which has been passed by both houses but has not made any statement either in support or against the accelerated casino licensing process. 

In addition to Cohen’s and Related Companies’ bids, other proposed casino projects in New York City include developments by SL Green/Caesars/Roc Nation in Times Square, Bally’s in The Bronx, Silverstein Properties in Hell’s Kitchen, and the Thor Equity consortium along the Coney Island boardwalk.

Proponents of the California sports betting initiative have submitted crucial amendments to their proposal to the state attorney general. The revised initiative not only addresses concerns raised by tribes and regulators but also introduces key changes that promise to enhance revenue sharing and inclusivity among California’s diverse tribal communities.

California Sports Betting Initiative’s Key Transformations

One of the pivotal alterations includes an increase in the revenue share for limited- and non-gaming tribes, a move that aims to rectify the disparities among different tribal groups. The amended initiative eliminates provisions that larger tribes found problematic, fostering a more unified stance among stakeholders.

The original proposal faced criticism from three California Indian tribes in 2021, who highlighted concerns related to offshore online gaming operators. In response, the proponents removed the contentious provisions, demonstrating a commitment to addressing the specific needs and worries of the tribal leaders.

Key modifications in the finalized initiative involve a boost in the percentage of operator revenue allocated to Revenue Sharing Trust Fund (RSTF) tribes to 25%. This replaces the previous 10% allocation to homelessness and mental health funding. 

Additionally, the initiative now limits the in-person sign-up requirement for online sports betting accounts to the first two years, allowing mobile sign-ups within a 10-mile radius of tribal casinos.

The initiative also introduces a five-year sunset for promotional credits, starting at 15% in the first year and gradually decreasing to zero. Furthermore, the start date for California online sports betting has been pushed to no earlier than July 1, 2025.

CNIGA Firmly Rejects California Sports Betting Proposals

Last month, the California Nations Indian Gaming Association (CNIGA) formally opposed two sports betting proposals, introduced by Kasey Thompson and Reeve Collins in October, aiming to regulate online and in-person sports wagering in the state. Following a vote by 52 CNIGA members, the association expressed irrevocable opposition, criticizing the handling of the initiatives and emphasizing the Tribes’ expertise in deciding what is best for their communities, urging the proponents to drop the proposals as promised in case of tribal opposition.

The next steps for the California sports betting initiative involve the state producing a fiscal estimate by December 18 and the attorney general releasing a circulating title and summary by January 2. Proponents, confident in tribal support, are prepared to fund the initiative entirely, from signature collection through the potentially costly ballot campaign, reinforcing their commitment to a zero-cost initiative for the tribes.

The California sports betting initiative, if successful, would amend the state constitution to permit sports betting on professional, collegiate, and select amateur sports. Tribal compacts with the state would include sports betting, and the initiative will legalize craps and roulette at tribal casinos.

The proposed bill seeks to address this disparity by allowing most federal laws that benefit other tribes to extend to the Wabanaki tribes in Maine, reported New England Cable News. However, it is important to note that the bill falls short of granting full sovereignty to the tribes.

The legislation specifically excludes certain federal laws pertaining to casinos, requiring state permission for their establishment. This provision aims to strike a balance between tribal interests and state concerns. Despite the exclusion, tribal leaders and supporters of the bill have expressed optimism about its potential benefits.

Passamaquoddy tribal representative, Rep. Aaron Dana, shared a troubling incident to illustrate the urgent need for change. He highlighted how his tribe was unable to seek aid from the Federal Emergency Management Agency (FEMA) when a cold snap caused pipes to freeze at a health clinic. Dana stated that he believed the bill could be considered the single most important in recent history due to the immediate and critical impact it could have on the Wabanaki tribes.

Critics Voice Concerns as Maine Tribal Bill Raises Potential for Conflicts and Lawsuits

However, critics of the bill have raised concerns about potential conflicts and lawsuits that could arise from its implementation. Governor Janet Mills’ chief legal counsel urged the tribes to collaborate with the administration to find mutually agreeable solutions rather than pursuing a bill that may create new complications.

The bill’s passage in the Maine House reflects a significant step forward in rectifying the inequities faced by Native American tribes in the state. While it falls short of full sovereignty, it represents progress toward achieving greater parity with other federally recognized tribes.

The Senate will now deliberate on the bill, and its fate will be closely watched by tribal communities and supporters throughout Maine. The Native American tribe bill comes at a time when the state of Maine is preparing to launch its sports betting market. The head of the state’s gambling regulator, Milton Champion, suggested that sports betting could go live in time for Thanksgiving, pending the review and approval of the revised rules.
