Singapore is set to implement significant changes to its casino regulations aimed at strengthening anti-money laundering (AML) and combatting the financing of terrorism (CFT) measures. The updates include lowering the threshold for customer due diligence checks and introducing new scrutiny for weapons finance. These measures will ensure that Singapore’s casino sector aligns with international standards set by the Financial Action Task Force (FATF).

Lowering the Due Diligence Threshold

The Gambling Regulatory Authority (GRA) of Singapore has announced a reduction in the cash deposit amount that triggers customer due diligence checks. Currently, this threshold is set at SGD5,000 (approximately USD3,685). However, the new regulations will lower this amount to SGD4,000 (approximately USD2,950). This change is expected to be implemented within the year, although the exact date has yet to be specified.

According to the updated Money Laundering National Risk Assessment, this reduction aims to enhance the casino sector’s AML/CFT regime. T. Raja Kumar, former president of the FATF and the inaugural chief executive of the Casino Regulatory Authority, emphasized the importance of aligning Singapore’s regulations with international standards.

Introduction of Weapons Finance Scrutiny

In addition to lowering the due diligence threshold, Singapore is also introducing new measures to address proliferation financing. This term, defined by the FATF, refers to funds or financial services used for nuclear, chemical, or biological weapons in violation of national laws or international obligations.

The proposed Anti-Money Laundering and Other Matters Bill, currently under review by Singapore’s parliament, includes provisions to tighten casino operators’ requirements for due diligence on the source of player funds. The bill will mandate that casino operators consider proliferation financing risks during customer due diligence checks. The Gambling Regulatory Authority of Singapore will be empowered to issue regulations to detect or prevent proliferation financing.

Enhanced Monitoring and Compliance

The Ministry of Home Affairs noted that the new regulations would require casino operators to conduct due diligence on patrons for any single cash transaction involving SGD10,000 (approximately USD7,371) or more, or when receiving SGD4,000 (approximately USD2,950) or more in a single transaction for deposit into a customer account.

Despite the moderately high risk of money laundering in Singapore’s casinos, the Money Laundering Risk Assessment Report Singapore 2024 reported no direct complicity by casinos in money laundering activities. However, there have been cases of third-party money laundering facilitated by casinos. One case involved an alleged conspiracy to cheat vessel owners of undelivered fuel, with proceeds amounting to about SGD1.9 million used to purchase casino chips.

Easing the Burden of Proof

The Anti-Money Laundering and Other Matters Bill also aims to ease the burden of proof in money laundering prosecutions. The amendment to the Corruption, Drug Trafficking and Other Serious Crimes (Confiscation of Benefits) Act will mean that prosecutors no longer need to show a direct link between criminal conduct and laundered money. It will be sufficient to prove that the money launderer knew or had reasonable grounds to believe they were dealing with criminal proceeds.

This change is designed to facilitate the prosecution of money mules, especially in cases where laundered money has passed through multiple bank accounts and intermediaries in foreign jurisdictions before entering Singapore.

Italy’s Custom and Monopolies Agency (ADM) has announced that starting June 1, 2024, new regulations will be enforced regarding bookmakers’ bonus management and the handling of palpable errors. New Regulations on Bonus Management

The ADM has established definitive rules through a specific decree on Bonus Management, detailing legislative criteria for the practical use of bonuses. These guidelines cover terms and conditions, payment methods, and the application of bonuses for ‘one-off’ tax purposes.

Under the current rules, Italian bookmakers face a ‘bonus limitation,’ restricting them from awarding more than a €100 bonus per customer on a fixed-odds wager. However, operators have expressed the need for a clear methodology to calculate the cost of these bonus rewards for tax and auditing purposes.

To address this, the ADM has clarified that “both the bonus used and any stake placed by the player will be included in the calculation of the amounts wagered and winnings paid.” This settlement aims to provide transparency and consistency in how bonuses are taxed.

Handling Palpable Errors

The ADM’s upcoming decree also introduces a regulated process for addressing palpable errors. These errors have historically led to numerous customer disputes, often requiring resolution through the legal system. Veikkaus, Finland’s state-owned gambling monopoly, has officially launched its new identification requirements. As announced in early November, the monopoly will now check the identities of players for all games.

In line with the identification protocols implemented for coupon games earlier in 2023, Veikkaus will now verify the identities of all of its players. The measure seeks to prevent harmed or excluded players from gambling and ensure a healthier gambling market. In addition to that, the identification measures will ensure that the Veikkaus is not allowing underage players to gamble.

The new identification system will work in the same way as the identification process for coupon games, such as Eurojackpot and Lotto. This means that players can confirm their identities with a Veikkaus Card, a Kela card or a digital Veikkaus card.

Veikkaus Says It’s the First Operator to Check the IDs of All Customers

Veikkaus representatives commented on the changes, saying that they will cement the monopoly as the first gambling company in the world to require identification for all of its games, be it digital or land-based.

According to Susanna Saikkonen, Veikkaus’ responsibility director, the identification system will have the added benefit of allowing players to easily track their playtime and spending and set annual loss limits. Bulgaria has finalized an overhaul of fees for gambling operators, increasing costs between two and four times. These measures should bring in roughly BGN 200 million ($112.62 million) in additional revenue for the government. Australia’s new ID laws will require bettors to present their ID cards before being able to play online. The new measure replaces the previous system where bettors had a 72-hour window to prove their identity.

Unlike before, gamblers will now be unable to place any bets or make deposits before showing their identity card. 

According to Responsible Wagering Australia, an independent peak body for Australian-licensed wagering service providers, this new measure would mitigate certain problems such as underage gambling or gambling harm.

By asking for ID before allowing consumers to play, companies will effectively prevent efforts to circumvent their social responsibility protocols. As a result, operators will be able to identify underage individuals or self-excluded players, stopping them from placing bets.

According to Kai Cantwell, Responsible Wagering Australia’s chief executive officer, over 90% of his organization’s members already verify customers’ identities. The change, he said, would bring the remaining companies up to standard.
