United Auto Workers (UAW), a union which also represents casino workers, has previously filed a lawsuit that wants to compel the state to remove Atlantic City’s nine casinos from the list of excluded properties where indoor smoking is allowed. The UAW’s lawsuit argues that the health of casino staff is put in danger because of the continuation of indoor smoking on gaming floors.

We Are All on the Same Side – Almost

Yet not everyone agrees. A pushback from the New Jersey Attorney General’s office is to be expected, but the camp against banning smoking for the time being also includes Local 54 of the Unite Here union, the state’s largest, which represents 10,000 casino workers and has filed an appeal with the Superior Court of New Jersey to dismiss the lawsuit brought around by UAW.

The filing says that workers stand to lose their jobs should a smoking ban be enacted, and further notes that only 25% of gaming floors are currently covered by the indoor smoking exemption. However, the lack of proper filtration between the smoking and non-smoking areas means that secondhand smoke does reach other parts of the gaming floor as well.

UAW is fighting on behalf of dealers at several major properties, including Tropicana, Bally’s and Caesars, with dealers usually the most impacted by smokers at their tables. Trinity Health, a not-for-profit health system, has also appealed to the state to heed the calls of the UAW and move forward with a complete ban on indoor smoking on the gaming floor.

New Jersey AG Matthew Platkin has already defended the state’s decision, and Gov. Phil Murphy, arguing that exempting certain areas of the gaming floors from the indoor smoking ban did not infringe on “any purported constitutional right to safety,” and has asked the Supreme Court to dismiss the lawsuit.

UAW lawyer Nancy Erika Smith, who filed the lawsuit on behalf of the union, has said that she was baffled by Local 54’s reaction, and the union’s decision to fight back against a measure that could ultimately only benefit its workers. However, Local 54 has greater concerns on their minds.

The union’s workers fear that banning smoking would lead to a downturn in casino footfall, which will in turn mean job cuts, with as many as a third of all workers running the possibility of losing their jobs.

To Light Up or Not to Light Up – This Is the Question

Donna DeCaprio, Local 54 president, has mostly sided with what has been said by casinos themselves. A complete ban on indoor smoking at casinos would be “catastrophic” and have serious economic ramifications for casinos and their staff. Yet, Atlantic City and New Jersey have other states to compare against.

Pennsylvanian properties that have banned smoking have not registered a downturn in revenue. Similar efforts to limit smoking are also undergoing in Rhode Island, Kansas, and Virginia. Yet, Local 54 believes that the worst possible scenario is the only one. A complete ban on smoking would significantly reduce the sector’s competitiveness resulting in job cuts.

It has already been tried once before, the union reminded, referring to a 2008 ban on smoking, which saw casino revenues drop by 19.8%. However, there is also evidence to support the claim that casino floors may be reinvigorated as more non-smokers come to Atlantic City to play in a smoke-free area. Besides, a lot has changed in the United States when it comes to smoking habits.

A quick historical comparison shows that in 2008, around 20.5% of the population smoked. The rate has declined to less than 11.5% by 2021, with the latest figures likely to show even further decline. The saga is ongoing, with no end in sight just yet.

On April 7, a woman in Jersey City, NJ won $200,000 at a Jin Ji Bao Xi Endless Treasure slot on the Tipico Casino platform online

new_jersey_senator_introduces_bill_to_increase_online_gambling_tax_by_30pctJohn McKeon, a senator in the State of New Jersey, has introduced a new bill which proposes a significant increase in the tax rate for online gambling and sports betting, bringing the figure to 30 percent.

The current tax rate for online gambling in New Jersey is 15 percent of gross gaming revenue, while the tax rate for sports betting is 13 percent of gross gaming revenue. The new bill, which bears the name of “Senate Bill 3064”, was filed two weeks ago and then formally introduced on 8 April. After that the bill was referred to the Senate State Government, Wagering, Tourism & Historic Preservation Committee.

The new bill basically amends two sections of the current legislation, Section 7 and Section 17, which stipulate the tax amount for sports wagering and online gambling, respectively. The proposal would take effect on the next 1 January that comes after the day of approval.

Still Lower Than Other States

The 30 percent tax rate would represent a drastic increase from the current rate in New Jersey, but it would still be lower than the tax rates established in other American states for online gambling and sports wagering.

New York for instance has a tax rate of 51 percent for sports betting, the highest in any competitive market in the United States. Pennsylvania comes in second place with a tax rate of 36 percent of gross gaming revenue.

States such as Delaware, New Hampshire and Rhode Island have tax rates above 50 percent of gross gaming revenue, but these states still run monopolies through state lotteries and don’t have competitive markets.

The current tax rate for online gambling in New Jersey is among the lowest in the country, with the state having 30 iGaming websites currently licensed and active on its competitive market. Connecticut has an 18 percent tax rate for online casinos, which is set to rise to 20 percent after five years, Michigan has a tax rate of 20 percent, while West Virginia takes 15 percent of gross gaming revenue from its online casinos.

The highest tax rate in the business remains the 54 percent imposed in Pennsylvania for slots, but that state seems to favor table games which have a tax rate of just 16 percent.

Ohio is an example of an American state that has recently increased its tax rate for online gambling and sports betting. In July 2023 Mike DeWine, the governor of Ohio, increased the tax rate from 10 percent to 20 percent.

The New Jersey Division of Gaming Enforcement has published data about the local casinos’ performance in Q4 2023, reporting a decrease in gross operating profit despite an increase in net revenue.

The report highlights Q4 net revenue of $781.9 million, reflecting a 1.3% increase year-on-year. As mentioned, gross operating profit declined by 3.6% to $148.5 million.

Additionally, the Division of Gaming Enforcement published data about its licensees’ full-year performance. According to the authority, net revenue reached $3.33 billion for the calendar year, representing an increase of 0.8% year-on-year. In the meantime, licensed casino companies in New Jersey reported FY 2023 gross operating profit of $780.7 million, a 4.1% decrease year-on-year.

The division also published hotel occupancy figures for the period, saying that casino hotels in the state reported a Q4 occupancy rate of 66.5%. This figure marks a slight 0.7% increase compared to the prior year period. The occupancy rate for the twelve months ended December 2023, on the other hand, reached 73%, which demonstrates a decline of 0.4%.

Most Hotels Experienced a Decline

The most profitable casino resort in 2023 was the Borgata with Q4 net revenue of $190.4 million and gross operating profit of $47.9 million. The property’s FY 2023 results included net revenue of $785.6 million and gross operating profit of $226.1 million.

Next up was Hard Rock with Q4 net revenue of $140.3 million and gross operating profit of $28.5 million. Its FY net revenue stood at $572.7 million, resulting in a gross operating profit of $125.5 million

Rounding up the top three, Ocean Resort posted Q4 net revenue of $119.8 million and gross operating profit of $26.6 million. The venue was one of the only three licensees to report an increase in gross profit for 2023, with net revenue of $491.8 million (+16.3%) and gross operating profit of $117.2 million (+21.8%).

Bally’s AC was notably the biggest winner in 2023 as it was able to greatly bolster its profitability from a gross operating loss of $1.8 million in 2022 to a profit of $11.1 million in FY 2023. Resorts Casino, on the other hand, saw its gross operating profit plummet from $21 million in 2022 to $9.5 million in 2023.

Here’s how New Jersey’s other licensees fared in terms of FY 2023 gross operating profit:

  • Caesars: $51.7 million
  • Golden Nugget: $29.8 million
  • Harrah’s: $80.6 million
  • Tropicana: $93 million
  • CIENJ: $23.6 million
  • Resorts Digital: $12.2 million

In other news, Atlantic City’s casino workers continue to push for a ban on smoking in the local casinos.

A New Jersey Appellate Court panel recently heard arguments in two cases concerning amendments to the state governing how much money casinos pay in lieu of property taxes. The cases, brought by Atlantic County and the nonprofit Liberty and Prosperity, revolve around changes made in 2021 that excluded internet gaming and online sports betting revenues from the calculations of casino payments.

The State Argues Casinos Require Special Treatment

In Superior Court in 2022, Atlantic County and Liberty and Prosperity prevailed in their lawsuits, contending that the amendments violated a 2018 consent agreement and the state Constitution. They argued that the changes resulted in a loss of approximately $5 million per year for county taxpayers, benefiting an industry detrimental to public health.

Despite the initial victory, the New Jersey Attorney General’s Office argued in favor of the amendments, emphasizing the need for changes to ensure a predictable revenue stream for casino taxes and to prevent potentially ruinous tax hikes. During the appellate court hearing, Tim Sheehan, representing the state, argued that the amendments were necessary to safeguard the financial stability of casinos and prevent closures.

The Legislature acted to exclude internet gaming and (online) sports gaming revenues … to ensure casino taxes continued in a predictable revenue stream.

Sheehan highlighted the rationale behind the amendments, citing concerns that a significant portion of internet gaming and online sports betting revenues went to third parties rather than the casinos themselves. He added the amendments were vital to avoid potential tax hikes, which could be disastrous for the broader sector and damage a leading contributor to the local economy.

The Amendments May Just Spread the Financial Burden

Despite the state’s concerns, Appellate Judge Francis J. Vernoia questioned whether the amendments effectively rescued casinos from ill-conceived business deals at the expense of other property owners. Seth Grossman of Liberty & Prosperity echoed this sentiment, arguing that the burden had unfairly shifted from casinos to non-casino property owners, adding the gambling sector did not need such a safety net.

So the amendment was to make sure the casinos kept more of the money? Aren’t we just rescuing a bad business deal?

The crux of the dispute revolves around whether the amendments violated the terms of the 2018 consent agreement and encroached upon judicial authority. While Sheehan contended that the Legislature had the authority to change laws at any time, Ronald Riccio, representing Atlantic County, argued that such changes cannot alter court orders.

The outcome of the appellate court’s decision is eagerly awaited, with Riccio acknowledging the unpredictability of judicial rulings based on judges’ questions during the hearing. The court should settle on a decision in the coming weeks, potentially impacting the tax obligations of New Jersey casinos and other property owners.

New Jersey Governor Phil Murphy decided to provide Atlantic City with a $20 million grant. The funding is part of a $100 million initiative that will allow local municipalities to restore their boardwalks.

The money is a leftover from the American Rescue Plan and will see New Jersey take care of its signature boardwalks. Originally designed to prevent sand from getting inside nearby hotels, these boardwalks are now beloved tourist attractions.

The Atlantic City Boardwalk in particular is a historic promenade that is believed to be the oldest one in America. Spanning some 5.5 miles, it is also one of the largest boardwalks in the world. The repairs are expected to improve tourism and also bolster local casinos’ business.

The $20 million grant will allow Atlantic City to take care of deteriorating parts of the boardwalk. The repairs will see old decking and pilings replaced with better materials that will allow the structure to last longer.

Governor Murphy added that many locals have cherished memories at the boardwalks of the Jersey shore, which is why they’ve become a prized destination. He hopes to keep them that way by allowing communities to repair and maintain these wooden main streets.

The grant awards announced today are a meaningful step in preserving the health and dynamism of these special places.

The AC Boardwalk Is a Lifeline for Local Casinos

The boardwalk is not only an important cultural asset but also an important economic driver, according to Jacquelyn Suárez, the acting commissioner of the New Jersey Department of Community Affairs.

The boardwalks are also very important to six of Atlantic City’s nine casinos since guests usually use the pathway to access nearby resorts. As a result, keeping these wooden streets in good condition is important to the city’s flourishing gambling industry.

For reference, the casinos dependent on the boardwalks include Bally’s, Caesars, Hard Rock, Ocean Casino, Resorts Casino Hotel and Tropicana.  

Speaking of AC’s casinos, the state continues to discuss whether the loophole that allows them to dedicate a part of their indoor space as a smoking area should be patched. While casino companies are concerned about potential losses, casino workers fear that the unhealthy environment is jeopardizing their lives.

In a month marked by unprecedented highs for New Jersey’s gambling industry, the state shattered multiple revenue records in January, signaling a robust start to 2024. However, amidst the celebration, there was a notable occurrence as traditional in-person casino earnings experienced a decline.

Internet Gambling and Sports Betting Reach Historic Highs in New Jersey

According to figures released by the New Jersey Division of Gaming Enforcement, January saw remarkable spikes across key metrics. Internet gambling revenue surged to a historic $183 million, marking a nearly 20% increase from the previous year, reported Associated Press. Sports betting also saw a monumental rise, with earnings reaching nearly $171 million, reflecting a staggering uptick of more than 136%.

While these numbers are cause for celebration, they also underscore a shifting landscape in the gambling industry. James Plousis, chairman of the New Jersey Casino Control Commission, highlighted the enduring impact of online gaming and sports wagering, emphasizing their role in providing a competitive advantage to operators, especially during traditionally slower periods like Atlantic City’s off-season.

The meteoric rise of online channels can be partly attributed to external factors such as harsher winter weather, which likely diverted brick-and-mortar activity towards digital platforms. 

Jane Bokunewicz, director of the Lloyd Levenson Institute at Stockton University, noted this trend, suggesting that the surge in internet gaming and online sports betting totals could be a consequence of adverse weather conditions.

New Jersey’s In-Person Gambling Struggles Amidst Online Success

However, despite the remarkable performance in online segments, the core concern remains the decline in earnings from in-person gamblers. In January, in-person casino winnings totaled just over $205 million, reflecting a 3.1% decrease from the previous year. This downward trajectory is compounded by the fact that in-person earnings continue to lag behind pre-pandemic levels, a trend observed since early 2020.

The disparity in performance among Atlantic City’s casinos further highlights the evolving dynamics within the industry. While newer establishments like the Borgata, Hard Rock, and Ocean reported gains in in-person earnings compared to four years ago, two-thirds of the city’s casinos are still grappling with lower revenues from traditional gambling activities.

Despite these challenges, the overall outlook for New Jersey’s gambling industry remains optimistic. The state’s casinos and tracks collectively recorded $1.71 billion in sports bets in January, setting a new record and surpassing previous benchmarks. This achievement underscores New Jersey’s resilience and reaffirms its position as a leading player in the legal sports betting landscape, alongside states like New York and Nevada.

In December 2023, New Jersey’s gambling industry saw significant growth across all segments, with total gaming revenue reaching $522.2 million, marking a 14.8% increase from the previous year.

Gross gaming revenue for online slot and table games soared to $171.5 million, which is the highest yield recorded in a single month by the regulator, the New Jersey Division of Gaming Enforcement.

Online Casino Games Lead the Way in November

The strongest online performance in iGaming has been posted amid increased spending on “at-home” entertainment options as confirmed by a recent PaySafe report, which indicated that inflation had not curbed enthusiasm for sports betting, and this may be spilling over into the iGaming sector as well.

The year-over-year results have been particularly encouraging with last month’s results ahead 17% of those posted in November 2022 with $146.1 million. Golden Nugget Online Casino topped the iGaming food chain, driving $50.1 million of the total gross gaming revenue, followed by Resorts with $47.2 million and Borgata Online with $37.9 million.

The retail sector has not done so hotly, though, with mostly nominal gains, as casino revenue amounted to $214.9 million or a slight 0.2% increase in the results. Table games contracted by 6.5% last month, although slots made headway with a 3% jump for a total of $161 million.

Interestingly, iGaming has been able to co-exist with the land-based sector and has mostly appealed to a different type of audience, ensuring that there is a steady footfall at casino properties around Atlantic City.

Jane Bokunewicz, a frequent commentator, and analyst on gaming results in New Jersey, has even gone further to suggest that there is a very strong argument to be made for the lasting quality of in-person gaming which is not going to be supplanted by online casino performance, which is often cited as a fear factor for regulating online gambling in states where he land-based casino resort industry is loath to move forward with iGaming.

Smoking Ban and Gambling Results Continue to Pose a Challenge

Meanwhile, a vicious debate is raging in New Jersey with casino workers and activists demanding from Atlantic City’s resorts to finally fold an exemption of the state’s public smoking ban, which still allows 25% of casino floors to offer smoking.  

Atlantic City launched iGaming in 2013, and ten years after the fact, the industry seems to be growing and setting up new records. Land-based casinos argue that their profits would plummet further if a smoke ban were enacted because they do not get all the winnings but share the proceeds from online games with third-party suppliers.
