Nebraska lawmakers are pushing ahead with a bill aimed at tightening regulations on skill gaming machines present in various establishments statewide. The bill, LB685, spearheaded by State Sen. John Lowe of Kearney, has passed its initial stages with a resounding 31-0 vote in favor.

Proposed Laws Tackle Skill Games’ Growth with Taxes and Stricter Regulations

Skill games, often found in bars, restaurants, convenience stores, and other locales, have proliferated significantly over recent years. Unlike traditional slot machines, these games require a degree of skill to win, blurring the lines between entertainment and gambling. However, concerns have been raised about their addictive nature and potential societal impacts.

The proposed legislation seeks to address these concerns by implementing several key measures, reported WOWT. Firstly, it introduces a 5% tax on the net profits generated by these machines, alongside a $100 fee per machine paid by distributors. For larger distributors with 50 or more machines, this fee would increase to $5,000. 

The generated tax revenue would be allocated to various avenues, including property tax relief, funding for enforcement measures, and contributions to the state’s tourism initiatives.

Moreover, LB685 aims to establish stricter guidelines regarding the sale of co-branded alcoholic beverages, preventing their proximity to non-alcoholic counterparts. This measure aims to mitigate potential confusion among consumers and ensure compliance with age restrictions on alcohol sales.

Nebraska Legislative Debates Highlight Concerns Over Skill Games’ Resemblance to Slot Machines

During legislative debates, concerns were voiced regarding the distinction between games of skill and games of chance. Some senators argued that these skill games essentially function as modified slot machines, emphasizing luck over skill. 

Additionally, there were apprehensions about the proliferation of these machines, with worries that they could attract criminal activity and exacerbate societal issues.

However, proponents of the bill argue that tighter regulations are necessary to prevent the unchecked expansion of skill gaming establishments. 

Last year Nebraska faced a surge in skill games with over 4,700 units spread across retail venues, prompting lawmakers to reassess regulation and taxation. Concerns mounted over addiction risks and unlevel competition, leading to calls for increased oversight and enforcement, mirroring similar debates in other US states like Pennsylvania and Virginia.

By imposing taxes and enforcing revenue thresholds, the Alabama legislation aims to deter the creation of de facto casinos and promote responsible gaming practices.The bill’s advancement marks a significant step towards addressing the complexities surrounding skill gaming in Nebraska. As the debate continues, legislators are tasked with striking a balance between fostering economic opportunities and safeguarding the well-being of communities across the state.

Virginia lawmakers find themselves at the center of a heated debate surrounding the potential legalization of what are known as “gray machines” – arcade-style games that bear a striking resemblance to traditional slot machines but incorporate an element of skill. 

Virginia Lawmakers Clash Over Introduction of Slot-Like Machines into Local Businesses

Endorsed by various gambling companies, competing legislative proposals seek to introduce these machines into a myriad of establishments, ranging from truck stops to convenience stores, across the Commonwealth, reported the Associated Press.

The discussion has intensified as stakeholders grapple with the regulatory framework for these devices, which have proliferated in recent years despite being prohibited under a ban enacted in 2020. 

Manufacturers argue that these games, while resembling slots, require a degree of skill from players. However, their operation exists in a legal grey area, prompting debates on oversight and taxation.

One proposal, championed by Sen. Aaron Rouse and co-sponsored by Sen. L. Louise Lucas, aims to establish a regulatory structure overseen by the Virginia Alcoholic Beverage Control Authority. Under this plan, establishments with ABC licenses could host a limited number of terminals, with revenue taxed at 15%. 

Proponents argue that such a move would not only generate significant revenue for the state but also benefit small businesses, particularly those owned by first-generation Americans.

McPike’s Proposal Takes a Different Path for Slot-Like Gaming Regulation in Virginia

Conversely, another bill put forth by Democratic Sen. Jeremy McPike offers a different approach. This proposal seeks to regulate both skill games and slot-like video terminals under the regulation of the Virginia Lottery Board, with a higher tax rate of 34%. McPike’s bill affords local governments the discretion to prohibit these machines if desired and mandates player identification requirements.

Amidst these legislative maneuvers, concerns have been raised by opponents, including casino interests, regarding the potential societal impacts of expanded gambling. Critics fear a surge in gambling addiction and associated social problems, citing reports of crime linked to similar devices in other jurisdictions. 

Additionally, questions linger about the adequacy of oversight mechanisms, with some advocating for stricter monitoring and reporting standards to prevent potential abuse.

Notably, in October the Supreme Court of Virginia reinstated the state’s ban on slots-like skill machines, reversing a lower court decision and signaling ongoing enforcement efforts despite pending lawsuits. The decision underscored the state’s authority to regulate gambling and protect the public, while also highlighting challenges faced by skilled game operators like Pace-O-Matic in Virginia and beyond.

Alabama lawmakers will convene on 6 February to deliberate on a comprehensive gaming bill that could usher in a new era for the state’s gambling landscape. The proposed legislation aims to introduce many of the most common types of gambling and institute the formation of an Alabama Gaming Commission, a brand-new regulatory body.

Gambling in Alabama Remains a Contentious Topic

Alabama’s constitution currently prohibits gambling, but there are 18 constitutional amendments allowing specific forms of gaming in certain regions. The legality of these provisions has long been a matter of contention among officials. However, unified gaming legislation should finally settle the matter and significantly expand available wagering options while introducing updated customer protection standards.

Governor Kay Ivey’s 2020 Study Group on Gambling Policy Report reveals that the potential windfall from gambling could reach up to $710 million annually. A lottery could generate $200-300 million, casino gaming $300-400 million, and sports betting $10 million. Revenue generated from taxes and fees under this bill would contribute to the Education Budget and the General Fund Budget.

Updated Regulations Should Create a Level Playing Field

Local news outlet 1819 News revealed that the upcoming bill likely intends to repeal all 18 constitutional amendments related to gambling. Additionally, the legislation aims to intensify efforts against illegal gaming, upgrading it from a misdemeanor to a felony with substantial financial penalties. Penalties for repeated offenses will also see an increase.

The bill proposes allowing Class III gaming in specific areas through an open-bidding process, replacing existing constitutional amendments. These areas include locations on federally recognized tribal lands operated by the Poarch Band of Creek Indians, Birmingham, Macon County, Greene County, Lowndes County, Houston County, Mobile County, and an undetermined county in Northeast Alabama.

Alabama Voters Will Have the Final Say

Each Class III gaming operation licensed by the commission may apply for one sports gaming license. The commission will issue all other sports gaming licenses not associated with a Class III gaming establishment with provisions for online sports betting. Other forms of online gaming will remain prohibited, but this measure still marks substantial progress.

Officials stress that this bill would not legalize gambling in Alabama without input from state voters but rather substantially reduce the number of gambling establishments due to the crackdown on illegal gaming. As a constitutional amendment, the bill would need a three-fifths majority in both legislative chambers, followed by a successful referendum, likely during the November general election.

In a recent meeting of Maryland’s Joint Audit and Evaluation Committee, legislators delved into the topic of problem gambling, specifically focusing on the potential impact of legalizing online casinos in the state. 

Experts Raise Alarms over Problem Gambling Surge

While retail sports betting was launched in Maryland in December 2021, mobile sports betting platforms were introduced a year later, raising concerns among experts and lawmakers about the surge in problem gambling cases.

Mary Drexler, the program director for the Maryland Center of Excellence on Problem Gambling, expressed her apprehension about the rapid expansion of online and mobile gambling, reported Maryland Matters. Drexler highlighted the growing number of calls, texts, and chats received by their helpline, indicating a demographic shift toward younger adults, especially minority males, seeking help for gambling-related issues.

Amidst these concerns, some state legislators have been advocating for the legalization of online casinos. Although legislation introduced during the 2023 session did not progress significantly, lawmakers agreed to commission a study on the feasibility of iCasinos in Maryland. This report, due by November 15, is expected to provide insights into the potential revenue that online casino gaming could generate for the state.

However, the prospect of introducing online casinos has raised worries about cannibalizing revenue from brick-and-mortar casinos, impacting the state’s Problem Gambling Fund. Currently, funding for problem gambling initiatives primarily comes from traditional table games and slot machines, with sports betting tax revenue not allocated for problem gambling research.

Senator Lam Proposes Funding Solution for Problem Gambling

Senator Clarence Lam voiced his concerns about the potential implications of online gaming, emphasizing the need for careful consideration. Despite these concerns, industry analysts like Matt Roob from Spectrum Gaming indicated that states with both online and physical casinos have not shown significant evidence of revenue cannibalization.

One possible solution discussed during the meeting was allocating a specific percentage of tax revenue from online casinos to the Problem Gambling Fund. This approach could potentially address concerns about funding shortages for problem gambling treatment and support services.

In July, a report exposed Maryland’s concerning struggle to support individuals grappling with gambling addiction, revealing that 8.6% of the state’s adults suffered from a gambling disorder in 2020, double the national average. While Maryland’s spending on safe gambling initiatives matches other states, it falls short, leading to a gap between affected individuals and available support. 

The state’s reliance on alternative revenue streams like expired prizes highlights the challenge. The potential introduction of iGaming exacerbates the situation, demanding urgent action, including enhanced treatment options, heightened awareness, and comprehensive collaboration, to address the alarming issue effectively.
