Rob Heller, CEO of Spectrum Gaming Capital, noted that while certain dreams in the industry remain unfulfilled, they also present opportunities for expansion, reported the Associated Press.

Shawn Fluharty, a West Virginia state delegate, highlighted New York and Maryland as probable candidates for embracing internet gambling in the near future. 

Brandt Iden, vice president of government affairs for Fanatics Betting and Gaming, echoed this sentiment, recognizing the complexities of passing online casino legislation and the need for lawmakers to better understand the industry.

Legislators Debate Impact of Online Gambling on Traditional Casinos Amid Industry Shift

The debate surrounding the potential cannibalization of revenue from physical casinos persists among legislators. However, industry executives argue that online gambling can complement traditional gambling establishments. Fluharty pointed out that Pennsylvania experienced an increase in casino openings after introducing internet casino gambling.

Maryland‘s prospective move towards legalizing internet gambling is accompanied by considerations of tax revenue and job creation. 

Meanwhile, New York lawmakers have advocated for internet gambling, although it was not included in Gov. Kathy Hochul’s budget proposal.

At the same time, a recent study conducted by Eilers & Krejcik Gaming (EKG) and commissioned by the iDevelopment and Economic Association (iDEA Growth) reveals that introducing online gaming in the six regulated US states boosts traditional casino revenue by an average of 2.44% quarterly. 

Edward King, co-founding partner of Acies Investments, expressed confidence in California eventually embracing online gambling due to its sheer market size. 

However, Adam Greenblatt, CEO of BetMGM, offered a differing perspective, suggesting that California may not approve online gambling soon, citing the state’s historical resistance. 

Similarly, Texas, another potentially lucrative market, has remained steadfast against online gambling for two decades.However, with Rhode Island recently joining the ranks of states offering internet gambling, the momentum for expansion appears unstoppable, with more states likely to follow suit in the coming years.

Rhode Island Lifts the Curtain on Online Casino Gaming

The key event here is not so much the arrival of interactive gambling, as online sports betting has been available in Rhode Island since late 2019. Last year, the state gave its go-ahead to Bally’s to operate an exclusive live casino with Stakelogic, a supplier with a global reach and a unique blend of live dealer games.

Rather, it’s a matter of introducing online casino games. Bally’s features 170 slot games and it also offers live dealer tables for blackjack and roulette, both of which are popular segments.

However, the online casino does come with some conditions. For one, to play online, players would have to be 21 years of age, as opposed to 18 years for the commercial casino. There are also a host of responsible gambling measures designed to ensure that online players are protected and have access to all they need to engage responsibly with gambling.

That includes session limits, spending and betting restrictions, cool-off periods, and of course self-exclusion. Rhode Island, a small state by any meaningful measure in the United States, has decided to pursue growth in yet another important gambling vertical.

Bally’s is hoping to continue adding to its online casino offer, although there may be a fast-reached ceiling for the actual growth with not that many players to go around. The Ocean State and the latest introduction of online casino games, though, begs the question of how soon before we see others follow suit. The gambling bill that made online casino gambling in Rhode Island is far from ideal, though.

Who May Be Next in the Race for iCasinos?

It only allows Bally’s to offer such products, and this is understandable as Rhode Island operates an exclusive based on an exclusivity model with the brand. Other states though are bigger, and there are already several potential targets for further expansion. Among the names that have openly discussed the idea are both Indian and Illinois.

Florida, which managed to push online sports betting through a tribal compact, has been openly tinkering with the idea of using the same arrangement and introducing online casinos, although all of these are rather far-fetched.

There is a compelling case to pursue growth in Indiana, too, as according to a recent study, the state stands to rake in millions worth of tax windfall, not to mention the added value to the economy. Anything new coming out of Illinois this year, though, is more likely to do with a proposed tax increase, however.

Lucky Eagle Casino found itself embroiled in a fatal shooting incident over the weekend, leading to the temporary closure of the establishment following a harrowing encounter between law enforcement and a murder suspect. This development perpetuates November’s unfortunate trend, as armed violence inside US casinos is becoming a regular occurrence. 

Witness Testimony Revealed Additional Details

The victim, identified as 33-year-old Darren Evans of Yelm by Thurston County Coroner Gary Warnock, was fatally shot by a Chehalis tribal police officer at Washington State’s Lucky Eagle Casino. Evans was the subject of a warrant for two counts of first-degree murder and unlawful possession of a firearm in Pierce County. The charges stemmed from a September 2022 incident in Graham, where Evans was wanted for murder.

On Sunday, Chehalis Tribal police and Thurston County Sheriff’s Office personnel received information suggesting Evans was inside the Lucky Eagle Casino. Upon attempting to make contact with Evans, an officer fired shots, resulting in fatal injuries to Evans. Eyewitness Dee Thomas, speaking for KOMO, described Evans running towards the casino exit before the officer discharged his firearm.

I think he tried to get to the front door exit, and then all of a sudden, I see the officer shot him right in the middle of the floor. I didn’t see a direct threat from the man.

Authorities have not disclosed the specific circumstances that prompted the officer to fire, nor have they clarified whether Evans was armed or posed a threat to the officer before the shooting. Efforts to save Evans following the shooting were unsuccessful, according to reports from the sheriff’s office. 

Casino Shootings Are Becoming Concerningly Common

Lucky Eagle Casino, operated by the Chehalis Tribe and located near Rochester, about 25 miles southwest of Olympia, announced its temporary closure in response to the tragic event. An establishment representative confirmed it would remain closed until further notice, expressing sorrow over the incident and the necessity of the closure during the ongoing investigation.

This newest shooting represents a concerning trend of armed violence at high-profile gambling venues. November saw a triple homicide near a casino in Robinsonville, MS, and similar reports of homicides related to the gambling industry have become increasingly frequent. While the courts often issue swift judgments regarding such cases, preventative measures remain lacking.

Alabama’s gambling industry has been lagging behind those of other states because of the Yellowhammer State’s fairly restrictive policies. The Alabama Democrats are looking to change that, hoping to make strides in 2024.

The Democrats are considering the introduction of a number of pro-gambling policies that would expand the state’s entertainment industry. Set to be introduced during the 2024 legislative session, the measures seek to tap into Alabama’s potential for gambling.

However, Alabama’s Republican-dominated government may prove difficult to convince. Republicans currently occupy both chambers of the Capital, holding 77 of 105 seats in the House of Representatives and 27 of 34 seats in the Senate.

If the Democrats wish to expand Alabama’s undeveloped gambling industry, they would need to strike an agreement with the Republicans.

Daniels Hopes to Reach an Agreement with the Republicans

According to the local news outlet WSFA, one of the biggest proponents of a gambling expansion is Minority Leader Anthony Daniels who believes that being pro-gambling is being pro-Alabama. He is convinced that growing the state’s gambling industry would provide significant economic boons, bolstering the economy.

Because of that, Daniels hopes to reach a productive agreement between his fellow Democrats and the Republicans.

Daniels’ plan is to introduce casino gaming, sports betting and lotteries to Alabama, helping it catch up with other states where gambling is legal.

We’re going to talk about proceed revenue sharing, folks from Tennessee, folks from Georgia, vendors that deal with the lottery, so that our members will be able to get a full picture.

For reference, Alabama currently lacks a state lottery. Last year’s legislative season saw the introduction of a lottery proposal that failed to gain sufficient traction. Alabama also sports three tribal casinos but doesn’t offer commercial gambling currently.

While previous efforts to legalize other forms of gambling in Alabama have failed, the Democrats remain bullish on expanding the state’s industry and capitalizing on the growth of gambling in the USA.

In any case, the expansion of gambling in Alabama is likely going to be an uphill battle with millions of dollars in tax money lot on the line.

Canadian financial technology specialist Nuvei unveiled a new partnership agreement with 888, a global gambling juggernaut. As per the deal, the former company will enhance the operator’s payment capabilities, helping it expand its presence in the United States.

According to the announcement, 888 will leverage Nuvei’s superior tech platform, acquiring reach, instant bank-to-bank payments and profound knowledge of iGaming to bolster its business while preventing risk.

Nuvei’s Instant Bank Transfer is the first payment method for instant account-to-account deposits and payouts in the US. This means that 888’s American customers will now be able to directly move funds between their 888 account and their bank card.

This is not the first time 888 and Nuvei have worked together. The fintech specialist has been powering 888’s European business with solutions ever since 2017. In addition, the tech company helped 888 make a foray into the Canadian province of Ontario, which legalized iGaming last year.

The new agreement with 888 cements Nuvei as a leading fintech provider to the iGaming industry. The company is well-known for its solutions that help operators maximize revenues while providing players with intuitive payment options.

Earlier this year, the provider also penned a partnership arrangement with Resorts Digital Gaming.

Representatives of the two companies shared their thoughts on the agreement. Nuvei’s chairman and chief executive officer, Philip Fayer, said that his team is excited to grow its relationship with 888. Fayer noted that the fintech provider is excited to help the operator expand by powering its US business with many key solutions.

Online gamblers in all US states should consult their state laws or seek legal counsel to determine if online gambling at unlicensed offshore websites or gambling venues licensed by regulators located anywhere but within their domiciled states is a crime or a right to be exercised freely by responsible adults. The same applies to federal gambling laws or any other ancillary issue related to online gambling.

Regulators from seven US states have contacted the United States Department of Justice in an attempt to nudge the DOJ into “doing something” about offshore competition in the online gambling market.

Not Understanding Federal Law?

As is usually the case when such actions occur, the signatories refer to all offshore gambling sites with a broad brush whether purposefully or not – lumping all other operators of gambling into one basket and broadly referring to them as “illegal online gambling sites.

At least that is the implication as state regulators and spokespeople from the American Gaming Association (AGA) consistently leave out any real differentiation among casino sites licensed offshore, illegal sportsbetting sites, and the very small handful of operators that provide services to players in the USA with no known license at all.

Painting every online gambling operator with the same broad brush appears to the informed consumer or observer as disingenuous at best.

The most recent public relations gambit is co-signed by regulators in some of the most financially successful US gambling states including Colorado, Illinois, Louisiana, Michigan, Mississippi, Nevada, and New Jersey.

Some of the issues addressed in the letter to US Attorney General Merrick Garland are some real and unreal dangers the ill-informed assume are associated with gambling online. These include age verification, money laundering concerns, responsible gambling protocol, game fairness, and the lack of each or any state capturing tax revenues.

The letter also states that offshore operators are not subject to any licensing requirements. The vast majority of those points are incorrect and are most likely based on good-faith misunderstandings of how offshore online gambling operators actually operate.

Well over 90% of offshore casinos and most sportsbooks that serve US players are licensed in the jurisdiction of Curacao (formerly known as the Netherland Antilles). Operators are required to verify the identity, age, ownership of financial instruments used to deposit, a player’s address, their subscription to local utilities, and quite often a copy of their bank account statements at a minimum.

Three Decades of Compliance

Operators in the offshore jurisdiction of Curacao have followed essentially the same protocol since the mid-1990s.

These documents cover nearly all of the concerns raised by the regulators including money-laundering concerns.

The over-arching government-sanctioned gambling license issuer makes sure that anti-money laundering concerns are taken care of through international authorities in compliance with an anti-money laundering/counter financing of terrorism (AML/CFT) framework that addresses both risk issues.

In a nutshell, what’s known as “document verification” – which is enforced by 99% of all offshore operators as any offshore player knows – addresses all concerns listed except responsible gambling issues and tax collections.

Responsible gambling is only addressed at the most critical level which is gambler self-exclusion. Even there, if an operator refuses to let a gambler self-exclude, they will have their Curacao license revoked. However, there are no auxiliary tools available for players to set deposit or time limits, force breaks at prescribed time intervals, or any of the other things more stringent regulatory regimes such as the Malta Gaming Authority or the British Gambling Commission may require.

That leaves the competition for the gambling dollar and state tax revenues buried in slurs of illegality, and black market accusations.

While this may seem to be counter-intuitive, offshore casinos are actually not illegal at the federal level nor have they ever been in the United States. It is, however, incumbent upon each consumer to check their own state laws to determine if the practice might be legal in their state. If competent legal counsel is indicated, that should be sought.

The Wire Act of 1961

Interstate or Inter-territorial sports betting is illegal in the United States and has been since 1961. While the US DOJ under various administrations has sided with casino moguls such as the late Sheldon Adelson in determining offshore casino gambling to be illegal, the world’s biggest lottery company by gross receipt,s, IGT recently sought and received a declaratory judgment (once and for all) that very specifically informs that The Wire Act only applies to sports betting operations. The act of casino gambling has no federal law to prohibit it.

The sticky wicket in this reality is the UIGEA (Unlawful Internet Gambling Enforcement Act of 2006) which neither creates new gambling laws nor modifies any existing laws as clearly stated in the law itself. It does, however, make most online financial transactions (deposits and withdrawals) illegal and de facto money laundering simply because US financial institutions have been given “guidance” that assumes the Wire Act applies to all interstate or inter-territorial wagers.

However, the very act of providing a gambling service or a US citizen partaking in offshore gambling is not a crime at the federal level by any law this editor has seen in nearly three decades in the industry. so it’s unclear how Attorney General Merrick Garland could be of assistance to state regulators unless he attacks the practice “from the side” and deems them all to be illegal thanks to incorrect guidance from the Federal Trade Commission (FTC) and the Federal Deposit Insurance Corporation (FDIC) which was issued during the Bush administration in 2007 under the false premise that the Wire Act actually applied to anything but sportsbetting.

In the letter to AG Garland, the Executive Director of the Michigan Gaming Control Board (MGCB), Henry Williams states: “In Michigan, strict laws and rules govern internet gaming and sports betting and provide consumer protections, promote confidence and ensure fair and honest gaming. We are willing to help the US Department of Justice in any way we can as it pursues enforcement of US laws against offshore illegal gaming enterprises that take advantage of our citizens.

State regulators like the MGCB ensure operators offer products that pass technical standards and testing, and we also require operators to comply with reporting requirements.

“Offshore operators flaunt state regulations and offer products that do not protect the public, which greatly concerns me and my fellow state regulators,” Williams added.

He continued, “Regulated operators recognize licensing is a privilege that can be taken away, but illegal operators do not face similar consequences for failure to follow laws and maintain integrity.”
